Social media platforms have become the world’s most popular and most used method of communicating, advertising and even contracting. From 2016, social media (such as Instagram, twitter, Facebook and snapchat) has been considered a ‘public place’ when it comes to article number 5 of law number 8. Therefore, any action committed on social media platforms would be a subject for criminalization.
Also, law number 63 for the year 2015 relating to Anti Information technology crime states that social media is no different to actual life when it comes to penalizing what we do, write or post (including videos and pictures). So, the criminal law will be applied against all criminal actions that take place. For example, if someone tried to insult, blackmail, slander or threaten a person on social media, he would be penalized with imprisonment for a period not exceeding three years and fined between three thousand and ten thousand KD. The Article clearly points at the person using the information network or information technology to threaten or blackmail a natural person or juristic person in an attempt to force that person to undertake an act or to abstain from it.
If the crime or threat is considered to be touching the dignity of a person, violating honor or defaming character or dignity, the penalty shall be imprisonment for a period of up to five years and a fine of not less than five thousand KD.
Moreover, the laws have also discussed online banking and contracting which brings us to the very common question of “Is it safe to do contracting online?”
Firstly, all emails are considered as trusted documents by the law, so if you received approval to sell an item through email then this email is actually a document that can be relied upon when it comes to judgment.
Secondly, you have to be careful which site you’re dealing with. There are some websites such as amazon, eBay and youbuy which are safe because they are globally authorized. Even companies like Mastercard, Visa, American Express and PayPal guarantee money transactions through those websites.
My advice to everyone is to be careful when dealing online and to be responsible for what they write or say on social media because even people with fake accounts and hidden names could be captured and jailed.< Back
